Mfused: L&I Investigation Results

Since the introduction of the new mylar zippered bag packaging at Mfused, members in production have been vocal about the pain and injuries caused to their wrists and hands from constantly opening and pinching these bags closed. Management had attempted to address the situation by ordering bags that supposedly come opened or outsourcing the task to other workers, but they still were not able to find a harmless solution. This led to multiple injuries and claims with Labor & Industries (L&I.) Meanwhile, L&I’s Department of Safety & Health (DOSH) had opened an investigation into a complaint made about the safety of this work. 

After some months and in-depth review from Occupational Hygienists, an Ergonomist, and (unlike most cases,) the head of DOSH, it has been determined that it is unsafe to open bags by hand and pinch bags closed by hand, even for part of a shift. The company has been given multiple serious citations, with one penalty, of which the amount has not been disclosed. Mfused must post a notice of their citations in the workplace for 7 days after it is received in the mail. L&I will not be checking on this, so if it is not seen or comes down early, please notify your shop steward or union rep.  

Employees, whether union members or not, should not be opening product bags by hand at all for any reason. If a batch of bags comes in sealed or partially sealed, please notify your manager and do not open them by hand. It is up to the employer to provide a safe way to get the job done, L&I has recommended finding a tool that can open and seal the bags without harmful repetitive motions. Do not open or seal bags until the company has provided a tool or machine that will help you do it harmlessly. Please notify your union rep when a tool or machine for opening/sealing bags is made available, or if you or another employee are asked to open or seal bags by hand. 

This is a win for members who have been saying that this work has been harmful to them all along, with injuries to show for it. Their voices have now been validated by safety regulators who have the authority to make management listen.

UFCW 3000 Member Story: Members Leaders Fight for Safety at the U-District Safeway

The University District in Seattle has long had reputation of having problems with people experiencing mental illness and substance abuse disorders. Unfortunately the housing crisis has only made these issues more visible and at times more dangerous. Workers at the Seattle U-District Safeway have been dealing with a series of increasingly violent incidents at their store, especially in the liquor department.

Prince Hart, Sean Ricco, Kevin, Daly, and Solas McGregor decided to take action to highlight their safety concerns. They started a petition to discuss their concerns and ways to help solve the problem. After collecting a majority of signatures of their coworkers they “marched on the boss” to talk with store management about the probelm.

Out of their talks they got agreements to post a security guard in the liquor dept during operating hours, an additional security guard to sweep the store, have two members scheduled in liquor so no one is alone, and the use of walkie talkies for dept leads to enable quick communication of potentially dangerous situations. U-D district Safeway workers now have some additional tools to deal with potential violence in their workplace.

Safeway can’t directly control larger problems outside the store, but it is clearly the Employer’s responsibility to provide a safe workplace and have a plan in place to deal with violence in the workplace. And workers have a right to take collective action to make sure the Employer lives up to that responsibility, and to push management to do more when necessary.

Your Rights During Flooding and Extreme Weather Events

Once again UFCW 3000 members and communities are facing some extreme fall and winter weather, including recent flooding. It is important to remember that if you, your family, or your coworkers have been affected by extreme weather, you have rights at work, resources through your union, and the support of your community.

Important rights and resources for UFCW 3000 members if your workplace, home, or transportation routes are flooded or evacuated:

  1. Just cause protections at work: With a union contract, you have “just cause” protection, meaning you should not be disciplined at work for reasonably having to deal with a circumstance outside of your control like a flood that affects your home, work, or commute to work

    • Be clear in communicating with your employer if you are unable to report to work on time or at all due to flooding or other extreme weather

    • Make sure to invoke your right to union representation if you are called into a meeting that could lead to discipline (we call these “Weingarten Rights,” read more here)

  2. The right to a safe workplace: If you feel unsafe at work, report any safety concerns to your worksite safety committee & management right away, and get support from your Shop Steward and/or Union Rep if your concerns are not addressed

  3. Union resources: If your home or work is affected by flooding or extreme weather and financial assistance would help, speak with your Union Rep about the UFCW 3000 Membership Assistance Fund

UNSAFE WORK ASSIGNMENT Q & A

During the COVID-19 crisis workers have been encountering situations that may be considered unsafe work assignments. In the normal day-to-day operations at work, workers are generally required to comply with management orders and directives. Complying with management directives is considered part of your job duties and not doing so can lead to discipline. Employees covered under a Union contract should usually "obey now, and grieve later." But situations might be different when you are being asked to do something unsafe. 

The following Q & A addresses a specific exception to the general rule that employees must obey orders and grieve them later.

Q:  I've been asked to perform a work assignment that I feel will threaten my personal safety and expose me to serious bodily harm.  Does my Union contract provide any protections for me?

A:  Because you are covered by a Union contract the answer is yes.  Your Union contract includes a just cause provision.  In this situation, just cause means you should not be disciplined for refusing to obey an unreasonable order.  An order to perform a work assignment that is likely to cause serious bodily harm to an employee is not reasonable.  To be covered by this exception, your fear of bodily harm must be objectively reasonable and not speculative.

Q:  Are there any specific laws that offer protection to workers who are asked to perform unsafe work assignments?

A:  Yes, there are state and federal laws that provide additional or separate protections.  One example is OSHA (click here to read an OSHA summary).

Q:  What should I say to my employer if asked to perform a work assignment that is likely to cause me serious bodily harm?

A:  It is always best to try to work with management to solve the problem.  For example, you should explain to management why you feel the work assignment is unsafe or dangerous so that your employer has an opportunity to problem solve.  You can also tell your supervisor you would be happy to accept the work assignment if it can be made safe to perform i.e., by providing you with adequate equipment or protective devices, adequate supplies, protective clothing, additional staffing, etc.     

Q:  Should I leave work if my employer insists that I perform the unsafe work assignment?

A:  No, under most circumstances, you should stay on site and remain available to work safe assignments.  If management sends you home, asks to meet with you to investigate the situation, or issues you any discipline, you should contact your union rep or the rep of the day immediately.

2023 Wildfire and Smoke Information for Workers

As our region again faces wildfire season, wildfires and wildfire smoke may affect us in the workplace and at home. Below are important things to know to stay safe and enforce your rights at work. Here are the most important actions to care for yourself and your coworkers during wildfire season:

  1. Report any safety concerns to your worksite safety committee & management right away, and get support from your Shop Steward and/or Union Rep if your concerns are not addressed.

  2. Get accommodations if needed and exercise your rights—use your sick leave if you become unwell; speak with a health care provider and use FMLA or exercise your disability rights under the ADA if you have a health condition that makes you vulnerable to wildfire smoke.

  3. If your home or work is affected by wildfire and financial assistance would help, speak with your Union Rep about the UFCW 3000 Membership Assistance Fund.

Workplace Safety for Wildfire Smoke

MASKS

  • You can wear a respirator mask at work that helps protect you against wildfire smoke.

  • Most masks we wear to protect against COVID do not actually protect against wildfire smoke. The right mask to protect against wildfire smoke is an N95 mask or other respirator with the same or higher level of protection. These respirator masks should have two straps and the word “NIOSH” and/or “N95” or “N100” printed on it.

EXPOSURE TO SMOKE

  • When the air is smoky, your employer should allow workers to follow basic steps that will help prevent excessive exposure to wildfire smoke—that could include things like reassigning workers to less smoky areas or allowing for extra rest and water breaks away from smoky work areas.

MEDICAL LEAVE AND ACCOMMODATIONS

  • If you or a family member gets sick because of wildfire smoke, you have the right to use Paid Sick & Safe Leave for illness

  • You may also be able to use your Paid Sick & Safe Leave if your child’s school or place of care, or your worksite has been shut down by a public official due to health-related reasons resulting from exposure to wildfire smoke

  • If you are vulnerable to smoky air due to an existing medical condition, talk to your health care provider about your workplace and see if they have recommendations for how to keep you safe from smoke exposure. Use FMLA if needed, or exercise your disability rights under the ADA.


Our advocacy paid off: Safer staffing is coming to Washington hospitals!

Our bill to address safe staffing in hospitals, ESSB 5236, was passed by the House earlier this month — the last step in a lengthy legislative process that we, in coalition with SEIU Healthcare 1199NW, UFCW 3000, and the Washington State Nurses Association, helped move forward with our actions, stories, and willingness to use our collective voice to ensure safer care in our hospitals. When we fight, we win!

The bill landed on Gov. Inslee’s desk to be signed into law on April 20, 2023. As of today, our bill is law.

The new safe staffing law will:

  • Strengthen accountability to hospital staffing plans set by staffing committees.

  • Eliminate CEO veto power over those plans.

  • Expand staffing committees to include LPNs, CNAs, and other direct patient care staff in addition to RNs.

  • Reduce hospitals’ ability to pack staffing committees with people who impede plans.

  • Create uniform reporting forms, which will mean that patients and healthcare workers will easily understand how many staff should be present.

  • Require hospitals to report noncompliance to the Department of Health (DOH) and the Department of Labor & Industries (L&I).

  • Allow DOH to issue corrective action plans that could require minimum staffing standards and fines.

  • Expand meal and rest break laws to include all frontline staff.

  • Close loopholes to make mandatory overtime laws fully enforceable.

  • Allow L&I to issue escalating penalties for missed breaks.

  • Funds the Washington State Institute for Public Policy to conduct a study of existing staffing plans.

Washington State House Passes Safe Staffing Bill — Next Up, the Governor’s Desk!

Today the House passed the healthcare staffing bill (ESSB 5236), the final legislative hurdle in a long process, to begin addressing the ongoing hospital staffing crisis this legislative session. The bill now heads to the governor’s desk.

We would not have gotten this bill through the Legislature without the countless members like you who sent in selfies, signed in “pro” on bills, contacted your legislators, testified in hearings, and so much more. The voices of healthcare workers at the bedside pushed the State Senate to go farther down the path toward safe staffing than ever before.

ESSB 5236 reflects a compromise between SEIU Healthcare 1199NW, UFCW 3000, the Washington State Nurses Association and the Washington State Hospital Association. The final compromise will strengthen accountability to staffing plans and allow for corrective action by state agencies if necessary up to and including enforcing safe staffing standards on hospitals. It represents a meaningful step toward safe staffing.

The final bill:

  • Strengthens accountability to hospital staffing plans. If hospitals fall below 80 percent compliance with their staffing plans, they are required to report noncompliance to the Department of Health (DOH) and the Department of Labor & Industries (L&I). Noncompliant hospitals will be assigned a corrective action plan by L&I and DOH, which may include elements like safe staffing standards set by L&I that the hospital will have to follow.

  • Expands meal and rest break laws to include all frontline staff, closes loopholes to make mandatory overtime laws fully enforceable, and ensures hospitals follow the law. If there are more than 20 percent of breaks missed in a month, L&I will issue escalating penalties.

  • Funds the WA State Institute for Public Policy to conduct a study of existing staffing plans to establish what’s actually happening in WA hospitals and compare them to elsewhere. This study would set a baseline understanding of the staffing crisis in WA by a credible, nonpartisan source, and provide a benchmark against California and professional association standards for staffing levels, which is critical for continued work to ensure safe staffing in Washington.

After the Governor signs the bill, we will turn to implementation and enforcement. We will be reaching out about plans to educate members – particularly members of staffing committees – on the elements of the bill.

UFCW 3000 Member Story: Liisa Luick

Liisa Luick is a dedicated shop steward from Macy's at the Alderwood Mall where she has worked since 2008. She loves advocating for her coworkers and fellow union members, knows her contract, and makes sure that store management knows it too.

When Macy’s reopened after the COVID-19 lockdown ended, Liisa also stepped up to make sure that safety issues with the ongoing pandemic and short staffing coupled with the ever-increasing problem of unruly customers and organized retail theft were being addressed. She went on to be featured as a spokesperson for her coworkers in the local press and the New York Times to highlight these important safety issues.

Recently she helped organize leaflets at her store in support of members of UFCW Local 5 working at the San Francisco Macy's, who had been negotiating their contract for over 8 months! Liisa also flew to the Bay Area to join UFCW 5 members at the bargaining table in a show of solidarity at what would be the final negotiation session where Local 5 reached a tentative agreement.

Liisa brought her experience back to her coworkers and joined the bargaining committee for the Macy’s contract negotiations that have gotten underway. As a member of the committee, she knows that the Union’s power starts and ends with what members are willing to do to fight for a fair contract. Liisa and all the Macy’s stewards and leaders keep their coworkers organized and out at every action. Way to go Liisa!

UFCW 3000 Member Story: Safeway #1550 Workers Organize to Win!

#WorkerWednesday is here and we want to spotlight the incredible organizing being done by grocery store workers & proud UFCW 3000 members at Safeway #1550 in the Roosevelt neighborhood of Seattle, WA.

Like many frontline, #EssentialWorkers at grocery stores across the PNW, the workers at Safeway #1550 have been dealing with many safety issues: cars being broken into, verbal assault, and harassment. One top concern was simply having a coded door to their break room so that workers could feel safe, knowing their personal belongings were not accessible to the public. Despite submitting the most store incident reports in their district to corporate about their concerns, management did not take any steps to address these issues.

One of the workers at Safeway #1550, Joaquin Viralta, came up with the idea of getting his coworkers to sign onto a petition. Leaders like Ian Bangs and many others soon took the drafted petition to their coworkers, getting over 80% of the store to sign on within 3 weeks. Ian and other worker-leaders represented their coworkers by delivering this petition to management. The workers received a commitment from management to: 1) install a coded break room door, 2) supply adequate PPE for each department, and 3) begin a program to help members get to their cars at night safe & sound.

This victory was only possible because of leaders like Joaquin and Ian stepping up, encouraging their coworkers to get involved with the union, and trying tactics like safety reports & the petition to successfully advocate for the change they needed in their workplace.

L&I Emergency Rule for 2022 Wildfire Season

L&I has adopted an emergency rule again this year, effective June 15 through September 29, 2022, to protect workers who may be exposed to wildfire smoke on the job.

This rule requires covered employers to:

  • Have a written wildfire smoke response plan.

  • Determine employee smoke exposure levels before work and periodically during each shift when smoke is present.

  • Train employees on wildfire smoke hazards.

  • Train supervisors on how to respond to health issues caused by wildfire smoke.

  • Inform employees of available protective measures against wildfire smoke.

Further requirements will depend on the level of smoke in the air, or the Air Quality Index (AQI)—read the summary or full emergency rules above for information, or talk with your Shop Steward or Union Rep.

Your employer may or may not be covered by the emergency rule depending on the potential for exposure to smoke in your workplace. But you should still report smoke-related safety concerns to your employer and alert your Shop Steward or Union Rep if your concerns are not addressed. The state L&I website reminds us:

“Employers are never allowed to retaliate against an employee for reporting an air quality hazard, an adverse health effect, or for seeking medical treatment due to a work-related illness or injury.”

Safety and Workers' Rights in Extreme Heat Situations

More and more, we face hazardous weather events like extreme heat that can affect us at work and at home. In dangerously hot conditions you can take action to stay safe and healthy, like drinking plenty of fluids, staying out of the sun, checking on vulnerable people, and taking extra precautions when outside.

Under the Occupational Safety and Health Act (OSHA), employers have a duty to protect workers from recognized serious hazards in the workplace, including heat-related hazards. Especially if you work outside, be aware of your health and safety during any Excessive Heat Warning, and check in with your coworkers. Extreme Heat at Work

OSHA has three basic recommendations for safety in extreme heat are: 💧 water, 🪑 rest, and ⛱️ shade.

Under OSHA law, employers are responsible for providing workplaces free of known safety hazards. This includes protecting workers from extreme heat. An employer with workers exposed to high temperatures should establish a complete heat illness prevention program.

  • Provide workers with water, rest, and shade.

  • Allow new or returning workers to gradually increase workloads and take more frequent breaks as they acclimatize, or build a tolerance for working in the heat.

  • Plan for emergencies and train workers on prevention.

  • Monitor workers for signs of illness.

If you perform work outdoors for more than 15 minutes in a 60-minute period, you may be considered an Outdoor Worker in Washington, and your employer may have responsibilities to you under Washington State’s emergency heat exposure rules effective through June 15, 2022. When temperatures are at or above 89 degrees, employers must provide outdoor workers with cool water and additional paid cool-down rest time, and when the temperature is at or above 100 degrees, employers must also provide other ways to cool down like a shaded area and ensure you have a paid cool-down rest period of at least 10 minutes every two hours.


Safety & Heat-Related Illnesses Information

Heat illness can be very serious. Learn the symptoms of heat illness and basic safety recommendations so you can stay safe at work and home.

Basic HEAT Safety Tips:

  • Spend more time in air-conditioned places if possible

  • Dress in lightweight clothing

  • Drink plenty of water and avoid drinks with caffeine, alcohol, and large amounts of sugar—sip frequently, don’t wait until you’re thirsty

  • Do not leave children or pets unattended in vehicles under any circumstances

  • Reduce activities that are tiring or take a lot of energy

  • When outside, limit the time you’re in direct sunlight

  • Do outdoor activities in the cooler morning and evening hours

  • During outdoor work, the Occupational Safety and Health Administration recommends scheduling frequent rest breaks in shaded or air conditioned environments

  • Anyone overcome by heat should be moved to a cool and shaded location. Heat stroke is an emergency! Call 9 11.

  • Call 911 right away—heat stroke is a medical emergency

  • Move the person to a cooler place

  • Help lower the person’s temperature with cool cloths or a cool bath

WHAT TO LOOK FOR:

  • Heavy sweating

  • Cold, pale, and clammy skin

  • Fast, weak pulse

  • Nausea or vomiting

  • Muscle cramps

  • Tiredness or weakness

  • Dizziness

  • Headache

  • Fainting (passing out)

WHAT TO DO:

  • Move to a cool place

  • Loosen your clothes

  • Put cool, wet cloths on your body or take a cool bath

  • Sip water

  • Get medical help right away if:

    • You are throwing up

    • Your symptoms get worse

    • Your symptoms last longer than 1 hour

WHAT TO DO:

  • Stop physical activity and move to a cool place

  • Drink water or a sports drink

  • Wait for cramps to go away before you do any more physical activity

  • Get medical help right away if:

    • Cramps last longer than 1 hour

    • You’re on a low-sodium diet

    • You have heart problems

Preexisting staff shortages have reached critical levels; nurses, health care workers and patients need immediate action from hospitals

SEATTLE -- The reality cannot be overstated: Washington hospitals are on the brink of a crisis, and without immediate and impactful action to retain and attract critical workers the state’s health care system could face an unprecedented collapse in capacity and care.

Hospitals across the state have warned of massive staffing shortfalls and collapses in capacity. Now the Washington State Nurses Association, SEIU Healthcare 1199NW, and UFCW 21 — who collectively represent 71,000 nurses and other healthcare workers — are urging hospitals to use the tools they have available to mitigate this crisis by retaining and adequately compensating current staff and filling under-staffed departments to ensure patient safety and access to care.

“Amid a fifth wave of COVID, spurred on by the Delta variant, and hospitals overflowing with patients who need critical care, our state health care workers continue to heroically perform their jobs a year-and-a-half into this pandemic,” said Julia Barcott, chair of the WSNA Cabinet and an ICU nurse at Astria Toppenish Hospital. “But nurses and other frontline workers are people, too. We’re losing overworked nurses to overwhelming burnout, the distress of working short-staffed, better-paying traveler nurse jobs and even for signing bonuses of up to $20,000 to move to a different hospital. We’re worried for our patients and the impact of the staffing crisis on the care they receive.”

This isn’t just a crisis for frontline workers, it’s also a public health crisis. Because hospitals were already understaffed well before the coronavirus pandemic hit, we are now seeing a new story every day about a regional hospital at maximum capacity. Without immediately addressing the shortage of staff and untenable workloads for frontline workers, there could be dire consequences to Washington’s health care infrastructure.

“Chronic understaffing is a disaster for patient care. Health care workers don’t want to see patients stuck in overflowing ICUs or being treated in ER hallways, or be forced to turn away ambulances at the door, but that’s the reality of health care right now,” said Faye Guenther, UFCW 21 president. “Hospitals need to immediately respond to this patient care crisis. That means focusing on meaningful, sustainable solutions that will recruit and retain qualified caregivers in every department.”

As many anti-vaccination activists falsely conflate the staffing crisis with looming vaccine deadlines for health care workers, it's important to understand that health care staffing shortages predate the coronavirus pandemic. As a result of years’ of staffing and management decisions, many hospitals already didn’t meet adequate staffing for average patient levels. COVID exacerbated this already strained infrastructure, and hospitals’ response to the pandemic has only worsened this preexisting crisis. 

“What’s really driving this crisis is that hospitals have spent the last two decades balancing their budgets on the backs of health care workers and patients,” said Jane Hopkins, RN, executive vice president of SEIU Healthcare 1199NW. “COVID has been a stress test on our health care system, and we are seeing the system fail that test due to management’s choice to understaff. Retention bonuses for frontline workers who have stayed on the job, adequate pay for extra hours worked, and aggressive hiring to staff at full capacity would go a long way right now.”

Washington State Department of Labor & Industries released updated requirements for Washington employers on June 30, 2021, recognizing the new phase of reopening we are in after the COVID-19 pandemic. If your employer is not following the state requirements for COVID safety in your workplace, talk to your Shop Steward or Union Rep right away, or submit a safety report with your name, workplace, contact information, and description of the safety issue to safetyreport@ufcw21.org.

Updated COVID-19 requirements for employers as Washington state reopens

Businesses in Washington state are able to open at full capacity and have fewer requirements to follow to protect employees from COVID-19.

Both OSHA and L&I continue to recognize COVID-19 as a workplace hazard for unvaccinated individuals. Employers have an obligation to provide a safe and healthy workplace and assess the level of hazard to determine if additional steps should be taken to protect workers who are not fully vaccinated. Updated rules and guidance detail the changes employers need to know.

Employers must:

  • Ensure unvaccinated employees wear a mask while working indoors.

  • Verify vaccination status before lifting employee mask requirements, and be able to show the process used for verification.

  • Keep employees with possible or confirmed cases of COVID-19 from working around others.

  • Provide handwashing facilities and supplies.

  • Train employees to recognize and respond to workplace hazards, including COVID-19.

  • Assess recognized hazards, including COVID-19, as part of the ongoing requirement to provide a safe and healthful workplace and, where appropriate, take additional steps to protect unvaccinated employees.

  • Notify employees in writing within one business day if someone they had close contact with tests positive for COVID-19 (without disclosing the person’s identity).

  • Report COVID-19 outbreaks of 10 or more employees at workplaces or worksites with more than 50 employees to L&I within 24 hours.

Masks and face coverings

  • Employers must provide cloth face coverings or a more protective mask to employees, free of charge, when use of a mask is required.

  • Employers may still require or encourage mask use, regardless of employee vaccination status.

  • Employees have the right to wear a mask or other protective equipment, regardless of their vaccination status, as long as it doesn’t create safety issues.

Industries where masks are still required for all workers  

  • Health care (long-term care, doctor’s offices, hospitals)

  • Public transportation (aircraft, trains, buses, road vehicles)

  • K-12 schools, childcare facilities and day camps in locations where children are or are expected to be present

  • Correctional facilities

  • Homeless shelters

Verifying worker vaccination status

Employers must be able to show the process used to verify employee vaccination status. They do not need to keep an actual copy of the employee’s vaccination records.

Acceptable types of verification include:

  • Vaccine card or photo of vaccine card.

  • Documentation from a health care provider.

  • State immunization information system record.

  • A hard copy or electronically signed self-attestation from the employee.

UFCW 21 members and staff participating in the Refuse to Abuse 5K in 2017, when we could all do it in person at the Mariners’ stadium in Seattle. This year, most people are participating virtually by walking or running a 5K in their neighborhood with friends, family, coworkers, or by themselves.

Once again UFCW 21 is partnering with the Washington State Coalition Against Domestic Violence (WSCADV) to raise awareness of domestic violence and fundraise for WSCADV at the Refuse to Abuse 5K. This year, the 25th anniversary of Refuse to Abuse, there is an option to participate in this 5K fundraiser from your home or neighborhood and support WSCADV.

There are three main reasons why UFCW 21 members participate in this annual event: 

  1. WSCADV is a UFCW 21 partner organization working to end domestic violence, which impacts members and our families in our workplaces and communities 

  2. Anyone on our union Sound Health & Wellness Trust gets their event registration fee reimbursed and HRA credit for participating in the 5K

  3. It’s fun to take part in events with fellow UFCW 21 members!

Domestic Violence is a Union Issue! 

We work with Washington State Coalition Against Domestic Violence because domestic violence is an issue that affects UFCW 21 members. One great way to celebrate this event even if you can’t participate is to familiarize yourself and your coworkers with workers’ rights around domestic violence. We’ve fought hard to pass laws in Washington State that protect us from work if we face threats of violence, stalking, or sexual assault.

UFCW 21 and PCC reach agreement on COVID safety and Hazard Pay!

After intense pressure from workers, shoppers, and community through petitions, leaflets, and other action we have finally reached an agreement with PCC on hazard pay for all stores outside of Seattle and Burien!

  • PCC agrees to extend $4 per hour hazard pay to all PCC workers in all stores through June, 5th 2021, expanding on the Hazard Pay ordinances won by UFCW 21 workers in Seattle and Burien.

  • We have a commitment from PCC to bargain over extending this agreement, including hazard pay, at least 30 days before it expires.

  • The agreement provides for Quarantine Pay for workers who get diagnosed with COVID 19 as well as other safety provisions.

  • PCC will begin a curbside pickup program that captures work for union members instead of giving it away to the gig economy.

  • We also reviewed our continued commitment to discuss new technologies in the stores before implementation.

20/20 Looking Back and Looking Forward

Dear UFCW 21 members,  

At the start of a new year, we find ourselves looking back and looking forward. 2020 was an intense year for most of us, and we face 2021 still in the grip of a public health and economic crisis, alongside a reckoning on racial oppression and an assault on our democracy.  

But we also face this new year together, as a union of over 46,000 working people. Many UFCW 21 members put their lives on the line in 2020 to show up for work and keep our communities fed, supplied, and cared for. Thousands of you newly joined us in 2020, making our union stronger in the face of challenges. We have grieved together, celebrated together, and stood side by side fighting for fair pay and safe working conditions.

We will win these at bargaining tables, through our city councils and state legislature, through outreach in the press, and directly in our communities and workplaces by speaking up for what we know is right, caring for each other so we can stay in the fight, and standing together in solidarity as a union family.

Grocery Store COVID-19 Safety Checklist

Coronavirus is a serious workplace health hazard. All employers have a responsibility to provide a workplace free of safety and health hazards. SAFETY CHECKLIST FOR GROCERY STORES IN WASHINGTON STATE

SIGNAGE:

  • Conspicuous signage at entrances and throughout the store with occupancy limits, policy on face coverings, six-foot physical distancing guidelines, and instructing customers to stay home if they are experiencing symptoms of COVID-19

  • 6-foot distance markers in checkout lines and other high-traffic areas to maintain 6 feet of physical distancing

PHYSICAL DISTANCING & BARRIERS:

  • 6-foot physical distance is maintained and enforced between all workers and all customers in all interactions at all times

    • Where strict 6-foot distancing is not feasible for a specific task, physical barriers (e.g., plexiglass shields) and other measures like limiting staff or customers in an area, or staggering break times and work times are used

  • Building occupancy is limited to appropriate level required by state or county regulations – As of 11/16/2020: 25% of building occupancy according to fire code, not including staff

  • Contactless payment systems, automated ordering, and pickup or delivery are used wherever possible

PERSONAL PROTECTIVE EQUIPMENT:

  • Cloth facial coverings are worn by every employee not working alone on the jobsite unless their exposure level dictates a higher level of protection

    • Reusable cloth face coverings are used when risk for transmission is low

    • Disposable masks are required when risk for transmission is medium, e.g. stocking produce around customers during store hours

  • Face coverings are cleaned or replaced after use or when damaged or soiled, are not shared, and are properly stored and discarded

  • Other personal protective equipment (PPE) is provided such as face masks, gloves, goggles, face shields as appropriate/required for

INFECTION CONTROL:

  • All workers are screened for COVID-19 symptoms at the beginning of each shift

  • Employees who feel or appear sick or have any symptoms of COVID-19 are immediately sent home

  • Employer completes all necessary steps when a positive or suspected positive COVID-19 cases is identified in the workplace

    • This includes notifying all close contacts of the positive or suspected positive worker(s) and allowing positive or suspected positive worker(s) to stay home and recover and all close contacts to stay home and quarantine for 14 days, regardless of whether close contacts are symptomatic

    • This also includes cordoning off areas where someone with probable or confirmed COVID-19 worked, touched surfaces, or spent any prolonged amount of time and following all CDC protocols to clean, sanitize, and disinfect the workplace before reopening them

  • A site-specific COVID-19 Supervisor is designated by the employer for the individual store

    • Worksite COVID-19 Supervisor monitors health of employees

    • Worksite COVID-19 Supervisor enforces COVID-19 job site safety plan

HANDWASHING & HAND SANITATION:

  • Handwashing required when arriving at work, taking breaks, using the bathroom, before and after eating/drinking/using tobacco products, and after touching contaminated surfaces

  • Frequent and adequate handwashing maintained throughout the day

    • Workers get breaks to wash hands regularly

  • Handwashing facilities have clean and hot or tepid water, soap, and paper towels and these are kept stocked

  • Hand sanitizer (with at least 60% alcohol) provided for workers and customers

SANITATION OF WORKPLACE, SURFACES, & EQUIPMENT:

  • Housekeeping schedule with frequent cleaning and sanitizing and an emphasis on surfaces that are regularly touched (“high touch” surfaces)

    • Sanitize and disinfect high touch surfaces frequently (e.g., restrooms, checkout counters, shopping cart handles, door handles)

  • Operating hours allow enough time to thoroughly clean, sanitize, and disinfect facilities between shifts

  • Increase frequency of washing utensils

  • Disposable gloves available and used for shared tools

  • Employee equipment including handhelds/wearables, scanners, radios, other tools are properly cleaned and disinfected before and after use

  • Fitting rooms (if available) are disinfected by an employee with appropriate supplies and PPE after each new customer use

  • Any items used by customers in fitting room and not purchased are removed from inventory and stored for no less than 24 hours

  • IN KING COUNTY: A designated sanitation worker is designated at all times to continuously clean and sanitize commonly touched surfaces according to CDC guidelines

  • IN KING COUNTY: There is a way to sanitize shopping carts and basket handles (can be with available wipes for customers or workers who sanitize between each use)

CUSTOMER COMPLIANCE & ENFORCEMENT:

  • Business does not serve customers or visitors who aren’t wearing face coverings

    • Individuals with medical conditions or disabilities are exempt from this requirement and are not required to carry proof of the condition or disability

    • Employer should offer to provide accommodation such as curbside pickup, delivery, or non-peak hour shopping for these customers

  • Customers must wear a face covering anytime they are not seated, and if seated anytime they are not eating

    • If seated dining is permitted by the state/county at the time, customers may remove face coverings to eat and drink, but must wear face coverings when sitting and not eating

    • As of 11/16/2020: All common/congregate seat areas and indoor dining facilities must be closed

PUBLIC HEALTH & COVID PLANNING COMPLIANCE:

  • Employer has a written plan addressing physical distancing, protective equipment, hygiene, cleaning, communication, screening, and disinfection of contaminated areas onsite and available to regulators

  • Employer notifies local health department within 24 hours if 2 or more employees develop confirmed or suspected COVID-19 within a 14-day period, or if employer suspects COVID-19 is spreading in the workplace

  • Employer cooperates with public health authorities in investigation of suspected and confirmed cases and outbreaks

  • Employer cooperates with infection control measures including isolation, quarantine, and environmental cleaning

  • Employer complies with all public health authority orders and directives

  • Employer fully complies with Washington’s High-Risk Workers Protection proclamation

TRAINING:

  • All workers are trained in the language they understand best about:

    • Signs & symptoms of COVID-19

    • How to prevent COVID-19 transmission

    • The employer’s COVID-19 policies (these must inform workers about the steps being taken in the workplace to establish social distancing, increased handwashing, and to prevent the spread of the virus

    • Handwashing length, duration, and frequency

    • Appropriate PPE use

    • Safe use of chemicals used to clean, sanitize, and disinfect

Puget Sound Grocery Store Workers Speak Out for Hazard Pay, Staffing and Safety

Thank you to all who attended, if you missed this online webinar where unionized grocery store workers share their experiences and feelings about improved safety and reinstating hazard pay you can watch it here.

Grocery store workers here in Washington and around the nation continue to go to work every day, risking exposure to the deadliest virus in over one hundred years. Despite these risks and the dramatic increase in sales and profits that grocery stores have recorded since the beginning of the pandemic, the hazard pay that had been put in place in March was cut by early summer. Workers are also feeling a lack of sufficient staffing at a time when the need for sanitizing and breaks are paramount. Unionized workers have continued to press for the hazard pay and improved safety procedures. With the recent new spikes of exposure, positive cases and deaths, workers are re-doubling efforts for safety, staffing and hazard pay.

Background:

Nine months into the pandemic front line workers like grocery store workers are still going to work every day, exposed to the virus and concerned with safety.  Early on during the pandemic, many stores like Safeway, QFC and Fred Meyer began paying workers an additional $2 an hour in hazard pay. In addition, we won increased safety protocols grocery store workers had been demanding, such as frequent disinfecting, wiping down carts and check-out stands, installing plexiglass, limiting the number of people inside the store to be able to allow shoppers to socially distance, asking shoppers to wear masks and allowing workers to take frequent breaks to wash hands and maybe get some fresh air.

At the very beginning of March 2020 our nation had its second recorded death from Covid. By the end of that month, the death toll had surpassed 1,500. By the early summer, in all counts, the pandemic had already taken a massive toll, was still out of control, and there was no end in sight. However, while profits and sales at grocery stores soared, workers’ hazard pay was inexplicably cut.  Workers who continued to do essential and hazardous work were apparently not worth the extra $2 an hour. Unionized workers’ protests delayed the pay cuts in some places for a month, but by mid-summer, it was all taken away.

Fast forward to today: our nation has recorded over a quarter million COVID deaths. The slow-down in daily rates of infection and deaths has now turned around, with spikes and new records set throughout the month of November. Workers continue to be exposed, but safety protocols in many stores seem to have become more lax, and reduced staffing has made it very difficult to take the time to do the extra work required to disinfect the store, check-out stations and carts, as well as making it hard to take more frequent rest breaks to wash hands and get fresh air. And the hazard pay that was cut from workers’ weekly checks has still never been reinstated.

Unionized grocery store workers in Washington and around the nation this week are calling out for improved safety, including safer staffing, and a reinstatement of hazard pay for hazardous work.

Grocery Store Workers speak out:

"As a grocery cashier, at least at my store, the best analogy I can give you is that every day is like that Snowmageddon period, where we had lines as far back as we could see, and we didn’t have enough cashiers. Customers are so used to it that they don’t even think about complaining, and the corporate heads think they can get by with it. It’s not because they can’t hire enough people; they’ve hired plenty of people. They just want to have a minimum crew and maximum profits. So we get worked to death because there’s fewer of us doing the work of many.  - Wil Peterson, 17-year Kroger employee 

"To my customers, I say you don’t need to be accepting these long lines. We have 13 check stands in my store. Today there were only 2 cash registers open. This is ridiculous. We’re speaking up about it. We’re working through our union to get a safer store. The way it is now means more strain on everybody — more work for us, customers in the store longer, backed up in the aisles, even though experts seem to say people should keep their shopping trips to 30 minutes. How can they do that if corporate isn’t listening to them and to us?" - Wil Peterson, 17-year Kroger employee 

“I just also want the company to work to keep me safe, and not run me into the ground. Our work is a lot more stressful than it used to be. In our department, we’ve grown in size but we’ve grown even more in how many orders are coming in. Everyone is tired. Everyone is getting worn down. Sections of the store can get so crowded, it’s impossible to keep social distancing and still meet our timelines for fulfilling orders. And I’m very conscious of the risk I’m exposed to. My partner is a nurse, and we have a lot more potential exposure than the people we know who can work from home. That risk is something that I don’t get to leave behind when I leave work—I carry it home with me. My job takes up so much more space in my life now.

On top of all this, on top of them cutting the hazard pay we were getting at the beginning of the pandemic, we’re getting squeezed to be more productive. We push trolleys with the orders we’re preparing all around the store, and they just increased the capacity of those trolleys by 50%. Now they’re so big we can’t see past them around corners, and they’re 50% heavier to push around all day. Lately, the only things any of us are talking about is how tired and sore we are. People are saying they don’t know how much longer they can stay.
